Terms and Conditions

Welcome to Atlas Vacation Homes. By making a reservation with us, you enter into a binding rental agreement and agree to comply with the following terms and conditions. Please read them carefully before booking.


1. Rental Agreement

This agreement governs all vacation rental bookings made through Atlas Vacation Homes, Inc. By confirming your reservation, you acknowledge and accept these terms in full.

Guest Responsibilities:

  • Report any pre-existing damage or concerns within 2 hours of arrival
  • Maintain the property in good condition throughout your stay
  • Accept financial responsibility for any damage, loss, or excessive cleaning required
  • Comply with all property rules, community guidelines, and local laws

2. Payment Terms

Deposits & Final Payment

  • Advance Bookings: A 20% deposit is required for reservations made more than 30 days before arrival
  • Final Payment: Automatically charged to your card on file 30 days before arrival, unless alternative arrangements are confirmed in writing
  • Last-Minute Bookings: Full payment due at time of reservation

Security Deposits

  • Select properties require a refundable security deposit
  • Deposits are returned within 7-10 business days after checkout, following property inspection
  • Deductions may apply for damages, missing items, or excessive cleaning needs

All charges are in USD. Guests are responsible for any currency conversion fees.


3. Occupancy & Guest Requirements

Maximum Occupancy

  • State law and property-specific limits strictly enforced
  • Exceeding occupancy may result in immediate eviction without refund

Age Requirement

  • Primary guest must be 25 years or older and present for the entire stay
  • Valid government-issued photo ID required at check-in

Authorized Guests Only

  • Only guests listed on the rental agreement may occupy the property
  • Unauthorized guests may result in immediate termination without refund

Prohibited Activities

  • No parties, events, or large gatherings
  • No smoking (indoor or outdoor) — violations incur minimum $500 cleaning/deodorizing fee
  • No pets unless explicitly authorized in property listing
  • No subletting or short-term assignment of the property

Community Rules

  • Quiet hours: 11:00 PM to 7:00 AM
  • Follow all HOA rules, parking regulations, and pool guidelines
  • Respect neighboring properties and shared amenities

4. Smart Home & Safety Technology

For your safety and property protection, homes may include:

  • Smart Thermostats: Remote temperature monitoring and control
  • Electronic Door Locks: Secure, code-based entry systems
  • Noise Monitoring Devices (NoiseAware): Measures decibel levels only — no audio recording or voice capture
  • Pool Safety Alarms: Required by law — tampering is prohibited and punishable by law

Privacy Commitment: No cameras, recording devices, or surveillance equipment are installed inside living spaces or bedrooms.


5. Last-Minute Reservation Requirements

For bookings made within 20 days of arrival:

  • In-person check-in at our Kissimmee office may be required
  • Valid photo ID and credit/debit card used for booking must be presented
  • Name on reservation, payment card, and ID must match
  • Additional security deposit may apply
  • Photo ID copy required at time of booking

6. Accidental Damage Protection (ADP)

Every reservation includes a non-refundable ADP fee for peace of mind.

Coverage Limits

  • Condos & Townhomes: Up to $1,000
  • Single-Family Homes: Up to $1,500

Important Details

  • Covered: Accidental damage to property contents, furnishings, and décor
  • Not Covered: Intentional damage, theft, negligence, or unreported incidents
  • Reporting Required: All damages must be reported to us within 24 hours to qualify for coverage
  • Not Insurance: This plan is administered by Atlas Vacation Homes and is not an insurance policy

Damages exceeding coverage limits will be charged to your credit card on file.


7. Cancellation Policy

Deposits are non-refundable in all cases.

Luxury & Signature Collection Properties

  • 60+ days before arrival: 20% cancellation fee
  • 30-60 days before arrival: 50% cancellation fee
  • Within 30 days of arrival: 100% cancellation fee (no refund)

Standard Collection Properties

  • 30+ days before arrival: 20% cancellation fee
  • 14-30 days before arrival: 50% cancellation fee
  • Within 14 days of arrival: 100% cancellation fee (no refund)

Important Notes:

  • Date changes or property changes are treated as cancellations and subject to the same fees
  • No refunds for early departure, shortened stays, or unused nights
  • We strongly recommend purchasing travel insurance

8. Travel Insurance (Highly Recommended)

Protect your investment against unforeseen circumstances.

Coverage Includes

  • Illness or injury
  • Severe weather events
  • Employment changes or job loss
  • Family emergencies
  • Optional: Cancel For Any Reason (CFAR) add-on

9. Hurricane & Weather Policy

No refunds or reschedules for weather-related events, including:

  • Hurricanes and tropical storms
  • Severe weather warnings or watches
  • Evacuation orders (unless mandatory for the specific property location)

We strongly urge all guests to purchase comprehensive travel insurance with weather coverage.


10. Check-In & Check-Out

Check-In

  • Standard Time: 4:00 PM
  • Access codes sent via email after final payment and signed agreement
  • Early Check-In: Available for additional fee, subject to availability (request in advance)

Check-Out

  • Standard Time: 10:00 AM
  • Leave property in reasonable condition — cleaning service included
  • Excessive mess may incur additional cleaning fees (minimum $150)
  • Late Check-Out: Must be arranged in advance; unauthorized late departure may result in charges up to one full night’s rate

Failure to vacate on time may result in relocation charges for incoming guests.


11. Property Amenities & Features

Pool Heating (Optional)

  • Available for additional daily fee
  • Must be booked for entire stay duration
  • Heating begins 24 hours before arrival
  • Weather conditions may affect heating efficiency

Resort Amenities

Atlas Vacation Homes manages privately owned properties within resort communities. While most homes have access to community amenities (pools, fitness centers, clubhouses), we cannot guarantee availability or access, as these are controlled by HOAs or third-party management.

Starter Supplies

Properties include starter supplies (toilet paper, paper towels, dish soap, laundry detergent, trash bags). Guests are responsible for replenishing items during extended stays.


12. Property Descriptions & Accuracy

All property descriptions, photos, and amenities are provided in good faith and updated regularly. However:

  • Minor variations may occur due to property maintenance, updates, or seasonal changes
  • Atlas Vacation Homes and property owners are not liable for minor discrepancies
  • We reserve the right to substitute properties of equal or greater value in emergency situations

13. Maintenance & Service Response

Our Commitment

  • Emergency Issues: Response within 2 hours (24/7 support line)
  • Non-Emergency Requests: Addressed during business hours or after your stay, as appropriate
  • Definition of Emergency: Issues affecting safety, security, or habitability (e.g., no AC in summer, plumbing failures, lockouts)

14. Price Match Guarantee

We guarantee the lowest publicly available rate on our official website.

If you find a lower rate for the same property and dates within 24 hours of booking, contact us:

  • Your reservation ID
  • Screenshot or link to the lower rate
  • Matching property, dates, and occupancy

We’ll verify and adjust your rate accordingly. Offer excludes third-party coupon sites, auction sites, and expired promotions.


15. Lost & Found

Items left behind may be returned at the guest’s expense via third-party courier service. Atlas Vacation Homes is not responsible for lost, stolen, or forgotten items.

Contact us within 48 hours if you’ve left something behind.


16. Limitation of Liability

Use at Your Own Risk

Guests use all property amenities, including pools, hot tubs, game rooms, and outdoor equipment, at their own risk.

No Liability For

  • Personal injury or illness
  • Loss or theft of personal belongings
  • Equipment malfunction or failure
  • Force majeure events (hurricanes, power outages, natural disasters)
  • Resort amenity closures or restrictions

Guest Responsibilities

  • Supervise children at all times, especially near pools and water features
  • Follow all posted safety guidelines and warnings
  • Ensure pool safety alarms and gates are functional and not tampered with

Tampering with pool safety equipment is illegal and may result in prosecution.


17. Force Majeure

If your reserved property becomes unavailable due to circumstances beyond our control (fire, flood, hurricane damage, condemnation, or sale), we will:

  1. Offer a comparable alternative property, or
  2. Provide a full refund if no suitable alternative is available or accepted

Our liability is limited to the amount you paid for your reservation. We are not responsible for consequential damages, travel expenses, or other costs incurred.


18. Governing Law & Dispute Resolution

This agreement is governed by the laws of the State of Florida. Any disputes arising from this agreement shall be resolved in the courts of Osceola County, Florida.

By booking with Atlas Vacation Homes, you waive the right to participate in class action lawsuits and agree to binding arbitration for dispute resolution.


19. Modifications to Terms

Atlas Vacation Homes reserves the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated “Last Updated” date. Continued use of our services after modifications constitutes acceptance of the updated terms.
